A trust is a fiduciary relationship where a settlor gives a trustee a right to hold title to property or assets for the benefit of a beneficiary.


Who can make an application for incorporation of a Trust?


1.   An Advocate;

 

2.   A Trustee;

 

3.   An Enforcer; or

 

4.   The Settlor.

 

Requirements required for incorporation of a trust in Kenya.


The following particulars are required for the incorporation of a trust in Kenya: -

     i.       proposed name which must have the word “Registered Trustees” at the end;

 

    ii.       objects or purpose of the trust;

 

   iii.       a duly completed application for incorporation;

 

  iv.       a petition to have the trust incorporated;

 

   v.       a duly registered trust deed and Constitution;

 

  vi.       statement of donor funding/commitment;

 

 vii.       title deed belonging to the trust or one of the trustees or other documents of asset or property ownership;

 

 viii.       current search indicating ownership position of assets listed;

 

  ix.       financial statement of the organization or of one trustee such as a current bank statement;

 

   x.       minutes appointing the trustees;

 

  xi.       brief summary of the trust;

 

 xii.       curriculum vitae of the trustees or employees;

 

 xiii.       diagrammatic representation of the common seal;


xiv.       certified copies of ID, KRA PIN and passport photos of the Settlor, Trustees, beneficiaries and enforcers (if any)
